AbstractThis article is offered as food for thought in light of current Delaware case law. The reader is cautioned that the law varies by jurisdiction and that it evolves over time. This article is not intended as, and should not be construed as, legal advice. Rather, it discusses considerations which may be addressed with legal counsel in the course of drafting individualized employment agreements. Physicians and employers are urged to seek legal counsel to ensure that their agreement reflects the intent of each party and the law as it exists when the contract is executed.
